If you have been injured to the negligence or wrongdoing of another person your choice in hiring a personal injury attorney is very important. Your choice of injury attorney can help you to get the most from your lawsuit.
How to Find the Best Personal Injury Attorney in Indiana for Your Case
While you can negotiate your injury settlement without the help of an experience attorney, insurance companies will usually offer you a lower settlement than they would if you were represented by an experienced personal injury attorney.
Starting Your Search
Today, many people begin their search for an attorney online. Some still use the Yellow Pages. However, a lot of attorneys get their business from referrals so ask friends and family members for their input.
You may also put a call into the local bar association for a referral (like the Indianapolis Bar Association).
Interview Lawyers by Phone
After you have gathered some recommendations, pick up the phone and call. You can learn a lot just by speaking with an attorney during a phone call. Think of it as an interview, and you are the one hiring.
Schedule an Initial Meeting
Now that you have narrowed down your list, call the lawyers and schedule an in person meeting. During your meeting you can continue your interview process.
Most personal injury attorneys do not charge a fee for an initial consultation, but you should check first. Some attorneys charge a retainer fee, while most injury attorneys do not charge a fee unless they recover money for your injury. These attorneys typically take a fee of 1/3 of any recovery PLUS any expenses.
What Should I Bring to the Meeting?
In order for the attorney to provide you with the best advice you should bring all the documentation related to your injury, including police reports, medical records and billings, and any correspondence you have had with the insurance company.
What Questions Should I Ask?
Asking the right questions may help you figure out what lawyer is right for you. Here are some ideas:
- Where did you go to school?
- Did you graduate with honors?
- Have you taken continuing education classes since graduating?
- How long have you been practicing law?
- How many injury lawsuits have you settled?
- Do you represent insurance companies?
- Would you handle the whole case or would you assign an associate to work on my case?
- Do you think my case will settle or go to trial?
- How much experience do you have as a trial attorney?
- If I want to settle will you follow my request?
- If I decline an offer to settle and want to proceed to trial, will you follow my request?
- Will you accept my case on a contingency fee basis?
- Are there any additional fees or expenses?
Warning Signs: When to Avoid a Lawyer
While each case is unique, you may wish to avoid attorneys who frequently defend insurance companies and instead look for attorneys with experience representing injured persons. Furthermore, you may also wish to avoid attorneys who request up front payment.
Lastly, you probably will want to avoid lawyers who will not honor your wishes or refused to sign a contract with you. Look for the following in a well-written agreement:
- What the attorney will do
- What you will do
- Legal Fees and Expenses
- Payment Schedule
- How you get out of the contract if you and the lawyer aren't getting along
