Results for Hamilton County Families
Every family's situation is unique. Here are examples of how we've helped.
$20M+ Postnuptial Agreement Enforced
Husband filed for divorce and argued that the postnuptial agreement was unenforceable. Jill successfully defended the validity of the agreement and secured the wife over $20 million in assets, including business interests, as the agreement required.
Prenuptial Agreement Defense: $1M+ for Wife
In a contested Hamilton County divorce involving a $3M+ marital estate, the husband claimed a prenuptial agreement entitled him to the majority of the assets. The Court agreed with JR and Jill's interpretation, rejected the husband's claims entirely, and ordered him to pay the wife over $1 million.
$625,000 Demand Defeated: Court Awards $36,000
Wife demanded $625,000 and argued the husband's inheritance should be included in the marital estate. JR established the husband's separate property interests and the Court rejected the wife's demand, ordering approximately $36,000 total instead.
Relocation Blocked: Child Stays in Westfield Schools
After a father relocated over an hour away and filed to move the child, JR filed an emergency motion arguing the relocation was not in the child's best interests. The Court agreed, kept the child in their Westfield school and community, and modified the father's parenting time to every other weekend.
Past results do not guarantee future outcomes. Every case is unique and results depend on specific facts and circumstances.

Common Questions About Indiana Divorce
How is property divided in an Indiana divorce?
Indiana is an equitable distribution state, not a community property state. Under IC 31-15-7, the court presumes that a 50/50 split of the marital estate is just and reasonable. However, this presumption can be rebutted based on factors including each spouse's earning capacity, whether either spouse dissipated assets, the economic circumstances of each spouse, and contributions as a homemaker.
How is child custody determined in Indiana?
The primary standard is the "best interests of the child" under IC 31-17-2-8. The court considers eight specific factors including the child's age, the parents' wishes, the child's adjustment to home and school, the mental and physical health of everyone involved, and the child's relationship with each parent. We help you present the strongest possible case for the custody arrangement that serves your children's needs.
Do I have to go to court for my Carmel divorce?
Not necessarily. Many divorces in Hamilton County are resolved outside of court through negotiation or mediation, which saves time, money, and emotional strain. However, if a fair agreement cannot be reached, particularly in cases involving contested custody or complex asset division, we are fully prepared to advocate for you in front of a judge in Hamilton County Superior Court.
What is Hamilton County Local Rule 29?
Hamilton County Local Rule 29 requires both parties in a divorce proceeding to exchange comprehensive financial documentation within 30 days of filing, including tax returns, pay stubs, bank statements, and business records. Failure to comply can result in sanctions or adverse evidentiary rulings. Because we practice exclusively in Hamilton County courts, we build Local Rule 29 compliance into every case from day one. How much does a divorce lawyer in Carmel cost?
We use honest hourly billing with no surprises. During your free consultation, we will discuss the estimated cost based on the complexity of your situation. You will receive detailed monthly statements so you always know exactly what you are paying for.
How long does an Indiana divorce take?
Indiana law requires a mandatory 60-day waiting period from the date of filing (IC 31-15-2-6). An uncontested divorce can sometimes be finalized shortly after the waiting period. Contested divorces with complex assets, custody disputes, or business valuations can take six months to over a year. We work to resolve your case as efficiently as possible while protecting your interests.
Can I get spousal maintenance (alimony) in Indiana?
Indiana is one of the more restrictive states for spousal maintenance. Under IC 31-15-7-2, maintenance is generally only available in three situations: if a spouse is physically or mentally incapacitated, for rehabilitative purposes (up to three years), or by agreement of the parties. We can evaluate whether your situation qualifies and advocate for an appropriate arrangement.
What happens to the family home in an Indiana divorce?
The marital home is part of the marital estate and subject to equitable division. Common outcomes include one spouse buying out the other's interest, selling the home and dividing the proceeds, or one spouse retaining the home as part of an overall property settlement. In Carmel, where median home values are well above the state average, the disposition of the marital home is often one of the most significant financial decisions in the divorce.
What should I do before filing for divorce?
Before filing, gather copies of important financial documents including tax returns, bank statements, retirement account statements, mortgage documents, and business records. Avoid making major financial changes like large purchases or transfers. Consult with an attorney before taking any action, because what you do before filing can significantly impact the outcome.
