JR Emerson — Indiana Personal Injury & Family Law Attorney
Founder and partner at Emerson Divorce and Accident Injury Attorneys. Former judge. AVVO 10.0 Superb. From Spencer, Indiana to courtrooms across Central Indiana — JR fights for injury victims and families with the preparation and intensity that wins cases.
Fighting for Injury Victims & Families Throughout Indiana
JR Emerson is the founder and a partner of Emerson Divorce and Accident Injury Attorneys, where he represents clients in both personal injury and family law matters throughout Central Indiana. Whether you have been seriously injured in an accident or you are navigating a difficult divorce or custody battle, JR brings aggressive advocacy and personal attention to every case. JR previously served the community as a judge for the Whitestown Town Court in Boone County, where he presided over traffic litigation and local ordinance matters.
He built his practice on a simple principle: people deserve an attorney who fights for them like family — not a big firm that treats them like a case number.
“When you’re hurt in an accident, insurance companies have teams of lawyers protecting their profits. And when you’re going through divorce, you need someone in your corner who understands what’s at stake. I level the playing field. My clients get the results they deserve — not lowball offers or unfair settlements.”
The Road to Law
I grew up about an hour from Indianapolis, in Spencer, Indiana, near Bloomington. After graduating from Owen Valley High School in 1986, I took an unconventional path to the law — I grew my hair long and sang in a rock band for a few years before eventually finding my way to Indiana University in Bloomington, where I earned a B.S. in Business.
Before law school, I worked in computer networking and then at Roche Diagnostics in technical support. That experience gave me an analytical mindset and a comfort with complex systems that translates directly into how I approach cases today — whether I am dissecting an accident reconstruction report, tracing assets through business entities in a high-net-worth divorce, or building a timeline of medical negligence from thousands of pages of hospital records.
I earned my J.D. from the Indiana University Robert H. McKinney School of Law in 2012 and founded Emerson Divorce and Accident Injury Attorneys that same year.
Perspective from the Bench
Something most personal injury and divorce attorneys cannot say: I have sat on the other side of the bench. I served as Judge of the Whitestown Town Court, where I oversaw likely thousands of cases and gained invaluable perspective on how courts actually operate. I saw what worked and what did not. I learned how judges think, what they respond to, and what wastes their time. That experience informs every case I handle today — I know how to present arguments, evidence, and motions in the way that judges expect and respect.
Why I Founded Emerson Divorce and Accident Injury Attorneys
After law school, I could have joined a big firm and billed hours for someone else’s clients. Instead, Jill and I built Emerson Divorce and Accident Injury Attorneys because we believed people in Central Indiana deserved better. Too many firms take on hundreds of cases, pass the real work to paralegals, and settle for whatever the insurance company offers first. That is not how I practice law.
At Emerson Divorce and Accident Injury Attorneys, every client works directly with a senior attorney. I handle my cases personally — from the first phone call to the final resolution. My clients have my cell phone number. When they call, they talk to me. That is the kind of firm I wanted to build, and it is the kind of firm we run every day.
Practice Areas
My practice spans personal injury and family law, and that combination is more powerful than most people realize. When an accident settlement becomes part of a divorce, when a custody dispute involves an injured parent, or when wrongful death damages need to be protected from estate claims — I handle the full picture.
Personal Injury
I fight insurance companies that put profits over people. Every injury case is handled on a contingency fee basis — you pay nothing unless I recover compensation for you.

Family Law
I bring the same intensity to family law that I bring to injury cases. When your family is at stake, you need an attorney who prepares like the case is going to trial — even if the goal is settlement.

My Approach
I believe in thorough preparation and aggressive representation. The cases that settle well are the ones where the other side knows your attorney is ready and willing to go to trial. Insurance adjusters know me. Opposing counsel knows me. They know I prepare cases for trial, not just for settlement — and that reputation matters.
Personal Injury Approach
Winning injury cases comes down to evidence. I work with accident reconstructionists, medical experts, and investigators to build the strongest possible case. I handle everything from the initial investigation through settlement or trial, and I keep my clients informed at every step. Insurance companies are more likely to make fair offers when they know the attorney on the other side will take them to court if necessary.
Family Law Approach
In divorce and custody matters, I take the same aggressive approach. I protect my clients’ parental rights, fight for fair property division, and ensure that settlements serve their long-term interests. I am particularly experienced in high-conflict custody cases, father’s rights, and high-asset divorces involving business valuations, retirement accounts, and complex property.
Why Clients Choose JR

Proven Results for Indiana Injury Victims & Families
These are actual results JR has achieved for his clients. Every case is different, but these outcomes reflect the thorough preparation, aggressive advocacy, and courtroom readiness he brings to every matter.
$1,500,000
Medical Malpractice Wrongful Death
Children of deceased mother received $1,500,000 after hospital’s medical malpractice killed their mother. We proved the hospital failed to properly monitor vitals and respond to clear warning signs.
$1,250,000
Fatal Truck Accident
Spouse of deceased wife received $1,250,000 after commercial truck ran stop light and killed her. We proved the trucking company’s negligent hiring and training practices.
Prenuptial Agreement Defense — $1M+ Judgment for Wife
Represented a Hamilton County wife in a contested divorce involving a marital estate exceeding $3 million and a prenuptial agreement the husband had required her to sign before marriage. The Court agreed with JR and Jill’s interpretation of the prenuptial agreement, rejected the husband’s claims entirely, and ordered the husband to pay the wife more than $1 million.
High-Asset Divorce — Favorable Settlement for Fishers Professional
JR represented a Fishers professional in a high-asset divorce where the marital estate included retirement accounts, trust accounts, and the marital home. The wife valued the marital estate at approximately $7.9 million. JR challenged the valuations and presented evidence that the estate was worth approximately $1.3 million less than claimed, giving the husband the leverage needed to reach a favorable settlement.
Contested Divorce — Court Awards $36,000 Against Wife’s $625,000 Demand
Represented a Boone County husband in a highly contested divorce. The wife demanded $625,000 and argued that the husband’s inheritance should be included in the marital estate. JR successfully argued that the inheritance was not marital property. The Court rejected the wife’s demand and ordered approximately $36,000 total — against a $625,000 demand.
Past results do not guarantee future outcomes. Every case is unique and results depend on specific facts and circumstances.

Outside the Office
When I am not working on cases, I am spending with my wife Jill and golfing. When our kids were young we are active in Boone County 4-H — yes, both Jill and I were 4-H families — and I spend a lot of time at my kids’ sporting events, coaching, and cheering from the sidelines.
I still love music. The rock band days are behind me, but I still sing — mostly for an audience of the car radio these days. I enjoy golf, basketball, and staying connected to the communities we serve across Hamilton County and Central Indiana.
My roots in small-town Indiana run deep. Growing up in Spencer taught me that how you treat people matters more than anything else. I carry that into every client meeting, every phone call, and every courtroom appearance.
